Yahoo's Jason Cole just tweeted something useful from the owner's meetings:

Ran into John Elway. He said Denver may try to re-sign Dumervil still, but wants to "let everybody calm down."

"May try to re-sign Dumervil?" That's not exactly the strongest language, especially knowing Cole was going to send it out to the world.

Apparently, the Dumervil story was so popular that it crashed Over the Top's servers, which is why they were offfline lately. Here's two examples of creative contract reworkings which are equivalent to the agreed upon contract.

because it it was indeed money he has already received, he has no doubt spent it..

Because of his inaction to properly return a legal document the Broncos had to terminate him..

Therefore who is responsible? Why should he not take at least the difference out of his new contract? He caused the issue not the Broncos.. They clearly told him they had to have the document back signed by 1:59 pm he failed to do that.. For whatever reason..

Yes it can but then we wind up with less money each of those years to spend on players.. Is that something we should have to live with for Dooms failure to meet a deadline?

If a party fails to live up to there part of the bargain then it is IMO their responsibility to MAN UP and absorb that loss..

He didn't get to spend that dead money penalty. That's money he was paid when he signed the deal back in 2010. It's just that the cap hit for the bonus is spread equally over the length of the contract. But because he was released the remaining amount hit the cap all at once this off season. No one is talking about him returning the money....

Like everything in business - and the NFL is a business - assume the worst, i.e., that Doom is gone, and we need to find his replacement. If something gets resolved quickly great, I would be thrilled, but I am looking at this as Doom being an ex-Bronco at this point. Just for the record, I am a lousy prognosticator.

This is how I see it.

You realize that cap money lost is money that doom has already spent.
I doubt he is interested in giving it back so the broncos feel good.

The only way to mitigate this issue since the NFL has already allocated that as dead money is FOR doom to accept an offer less that amount and play..

So 8 million less close to 5 mil. Equals 3 million for his services this year.

Do you see that happening when NE, BAL and others are going to offer him 6 plus. And laugh at our misfortune all the way to the Super Bowl.

"May try to re-sign [him]" sounds like an appropriate comment, actually. Neither side wants to appear overeager at this point. Comments from Dumervil's side about checking out the market are in the same vein.

It's all about re-starting the courtship anew, since Dumervil's bargaining position is different now. The Broncos gave permission for contacts with other teams but any discussions were in the context of offers to a player still under contact. Now it's for real. And now the money is for real, too, so teams may not be willing to 'over-offer.' And, of course, there are a few cash-rich teams who may, which I'm not denying. However, most of those are undesirable situations.

I could be accused of 'homer-ism' but Dumervil's best prospective situation appears to still be Denver. The higher quality landing spots don't want to pay any more than the Broncos are willing to, and often less, and possible overbidders are typically bad situations -- quite honestly. It's going to take some time for he and his agent, Condon, to realize this, which is why the "we may try to re-sign [him]" nonchalance is strategically important. I'm reminded of prospective dance partners who go to great lengths to appear uninterested while at the same time assiduously preserving their availability.

The cap space can be restored through creative contract language. As long as Dumervil is willing to accept the 8 million salary number, there's no reason that he and the Broncos can't come together on terms. A new contract has to be written up, but neither party needs to 'lose' anything (in total dollars paid) as a consequence of the fax imbroglio. Admittedly, the timing of payments will change, but this looks like a problem that could be resolved, especially if both parties are still intent on reaching a deal.

We can still rewrite his contract to achieve an equal payout to him while also maintaining 'our' (the Broncos') cap number. Over The Cap provided two examples of how we could do this. The point is that the Broncos and Dumervil can still agree upon an equivalent contract if both parties are still willing, so Dumervil wouldn't have swallow any more pay reductions, nor would it hurt the Broncos.

Elway laid out the difficult position that the team was now in. Doom maintained with wavering voice that all he really wants is to be a Bronco again. Elway was deeply affected, though he knew his hands were now somewhat tied. "We can't wait long. Let's see what the NFLPA comes up with and take it from there." "Agreed," said Doom.

That's how I'd like to think the conversation would have gone.

Fiction? Sure. But I hope not entirely.

That's really the only logical response to the situation. They just lost $5 million in cap space in this debacle and they have to reassess what needs to be done with their available money. Best thing for the Broncos would be the NFLPA and the NFL agreeing to accept the agreement that missed the deadline.

I see it as we wanted him at 6.5 they dicked around and it cost us a couple extra mil over what we knew we were gonna get hit in the dead money area, now that come soff the 6.5.. if he wants it great, we will be glad to have him back but him and his agent cost us money and it has to come from somewhere..

Doesn't it also depend on if the NFLPA can accomplish anything? I understand there is precedent, and it's possible that if the union gets behind Doom the Ginger Hammer may find himself forced into a position to allow the verbal agreement to pass.

All parties involved just suffered a "bad beat" in the poker game that was this contract negotiation. I definitely think getting up from the table and taking some time to clear the air is a good move. Then again, this could just be further posturing from Elway in Elvis' direction to say, "go ahead and chase that money somewhere else if you really want to...but we think you will end up wanting us more than we'll want you when it's all said and done."
